Colorado State University-Pueblo PARKING RULES AND REGULATIONS
SECTION 1 - TITLE, AUTHORITY, PURPOSE AND ENFORCEMENT
ARTICLE 1 - TITLE
These regulations shall be known as the Parking Rules and Regulations for Colorado State University-Pueblo (the University).
ARTICLE 2 - AUTHORITY
The regulations contained herein are established under the authority of the Board of Governors, granted in the Colorado Revised Statutes Sec. 23-5-106 and 23-5-107 Et. Seq. to establish and make regulations for the well ordering and government of Colorado State University-Pueblo (University) and to promulgate rules and regulations providing for the operation and parking of vehicles upon the grounds, driveways or roadways within the property under the control of the Board.
ARTICLE 3 - ENFORCEMENT
- It shall be the duty and responsibility of all officers and employees of University Public Safety, including any entity contracted to provide security or traffic control services to the University, unless otherwise provided herein, to support and enforce these regulations.
- University Public Safety can suspend enforcement of restricted parking spaces when special events require such suspensions.
- No person can authorize persons to park or drive in violation of these regulations without prior written permission of University Public Safety.
ARTICLE 4 - PURPOSE
The regulations contained herein are established under the authority of the Board of Governors of the Colorado State University System, for the well ordering and government of Colorado State University-Pueblo and to provide for the safe and controlled operation and parking of vehicles upon the grounds, driveways, or roadways within the property under the control of the board.
ARTICLE 5 - EFFECTIVE DATE
These regulations are effective for Colorado State University-Pueblo beginning August 29, 2005.
ARTICLE 6 - DEFINITIONS
The following words and phrases shall have the meanings ascribed except where the context clearly indicates a different meaning.
- Campus: Colorado State University-Pueblo property.
- Department: University Public Safety, including any entity contracted to provide security or traffic control services to the University.
- Driver: every person who drives or is in actual physical control of a vehicle.
- Emergency Vehicle: any police vehicle, fire department vehicle, ambulance or other vehicle authorized by permit by University Public Safety.
- Faculty and Staff Members: all full-time, temporary, special, or regular general faculty, professional exempt, and State classified personnel including all non-student hourly or part-time non-student temporary employees, faculty in a transitional appointment status, and resident employees of cooperating agencies housed on campus.
- Motor Vehicle: every vehicle, as herein defined, which is self-propelled without distinction between federal, state, or private ownership.
- Motorcycle: every motor vehicle designed to travel on not more than three wheels in contact with the ground.
- Motorized Bicycle: a vehicle having two or three wheels with operable pedals which may be propelled by human power or helper motor, or both, with a motor rated no more than two-brake horsepower, a cylinder capacity not exceeding 50 C.C. and an automatic transmission which produces a maximum design speed of not more than thirty miles per hour on a flat surface.
- Owner: a person who holds the legal title of a vehicle or is the registered owner.
- Operator: every driver of any mode of travel other than afoot.
- Parking Decal: a University-issued decal which affixes permanently to the vehicle.
- Parking Permit: a University-issued card to be displayed as indicated on the permit or as instructed by University Public Safety.
- Roadway: that portion of property improved, designated or ordinarily used for vehicular traffic.
- Regulatory Sign: all traffic control devices, signs, signals, markings placed or erected for the purpose of regulation, warning, or guiding traffic.
- Service Vehicle: any vehicle clearly marked with a firm or company name; or governmental license plate being used to provide service, commodities or designated by permit by University Public Safety or by University Facilities Management.
- Standing Violation: every cited violation of these Rules and Regulations not declared null and void by University Public Safety or the Parking Appeal Board and those which are beyond the appeal period.
- Student: all persons enrolled for credit or audit for one or more hours of graduate, undergraduate, or conference work except faculty and staff members. Extended Studies students who receive course credit are considered to be students for purposes of these Rules and Regulations.
- University Public Safety: University department charged with enforcement of Parking Rules and Regulations and traffic laws on the campus, including any entity contracted to provide security or traffic control services to the University.
- Unpaid Violation: every standing violation not paid seven days from the date of issuance.
- Impoundment: towing and storage of motor vehicle at the expense of the owner and/or operator.
- Vehicle: every device in, upon, or by which any person or property is or may be transported or drawn.
- Visitor: every person who is not a student, faculty, or staff of the University.
SECTION II - APPLICABILITY AND DIVISIBILITY
ARTICLE 1 - COVERAGE, GENERAL
The regulations contained herein shall apply to all vehicles and users thereof, coming upon, or parking on the campus of Colorado State University-Pueblo, unless otherwise provided in these Rules and Regulations. The provisions of these Rules and Regulations shall apply to the operator of any vehicle owned or operated by the United States, the state of Colorado or any county, city, town, public corporation, or any other political subdivision of this or any other state, except as otherwise provided in this division.
ARTICLE 2 - EMERGENCY VEHICLES, EXCEPTIONS
The operator of an authorized emergency vehicle may park or stand, irrespective of the provisions of these Rules and Regulations and may operate his/her emergency vehicle on the University campus in accordance with the provisions of the Colorado Motor Vehicle Code regulating the operations of emergency vehicles within the state.
ARTICLE 3 - VISITOR EXCEPTION
Visitors may park in areas as indicated on VISITOR’S PERMIT or as instructed by University Public Safety. They shall not park in reserved parking areas, restricted zones, red zones, roadways or "NO PARKING ZONES". Visitor permits may be obtained at Cashier’s Office or University Public Safety in the Administration Building.
ARTICLE 4 - RESERVED PARKING
Reserved decals will be issued and honored for a specific area only. Reserved decals/permits are issued only when requested by the respective administrative department, directors, or deans of the University schools and when parking space is available. Priority is assigned on a need basis.
ARTICLE 5 - SERVICE VEHICLE EXCEPTIONS
The operator of any service vehicle or governmentally owned vehicle can receive proper written permission from University Public Safety or University Facilities Management to stand, park or drive in violation of these Rules and Regulations when the service is being provided so requires and so long as life or property is not endangered.
ARTICLE 6 - DIVISIBILITY
Should any division, article or paragraph of these Rules and Regulations be declared unconstitutional or void by any court of competent jurisdiction, the remainder of these Rules and Regulations shall remain in effect. Under such circumstances, the president or his/her duly delegated agent, shall have the authority to establish a new division, article or paragraph for that which has been declared void or unconstitutional, without prior submission to the Board of Governors, in order to give full force and effect to the intent and the purpose to these Rules and Regulations. Any new section, article, or paragraph shall be submitted to the Board of Governors for ratification as soon thereafter as is practical.
ARTICLE 7 - COLORADO MOTOR VEHICLE CODE, INCORPORATION
All of the laws of the state of Colorado and Pueblo city ordinances concerning vehicles and their operation, including but not limited to the Colorado Motor Vehicle Code, are hereby incorporated in these Rules and Regulations as if reproduced herein in full. Pursuant thereto the posting of signs regulating traffic and parking by University Public Safety shall be deemed to have been duly done by local authority as therein defined.
SECTION III – PARKING LOT DESIGNATIONS
ARTICLE 1 – PARKING LOT DESIGNATION
All parking areas of the University are color coded. Signs posted by University Public Safety overrule color coded parking lots. Temporary unpaved parking lots also require parking permits
ARTICLE 2 - COLOR CODING DESIGNATIONS
- White stripes indicate parking for student, staff and faculty.
- Blue stripes indicate handicapped parking.
- Green stripes indicate parking for staff and faculty and reserved parking where so indicated.
- Yellow stripes indicate no parking.
- Red stripes indicate a fire lane where parking is prohibited.
- Restricted parking is as posted.
- Motorcycles must park in designated motorcycle parking areas only.
- Students should always park between two white lines.
SECTION IV - PARKING PERMITS/DECALS
ARTICLE 1 - REQUIREMENT
Any vehicle parked on the University campus by faculty, staff, student or other members of the academic community must display a valid CSU-Pueblo parking permit or decal to park in any lot or space on campus. A one week grace period from the first day of classes each academic semester will be granted.
ARTICLE 2 - ELIGIBILITY
- All faculty, staff, students, or other members of the academic community demonstrating a need for parking privileges are eligible to apply for a parking permit or decal. Additional permits or decals are available as per the charges listed in these Rules and Regulations.
- No eligible person shall register a vehicle, or receive a parking decal for a vehicle which is not his/her own or that of an immediate member of his/her family. Immediate family includes any relative domiciled at the applicant residence. A permit may not be purchased for the use of an individual who is not entitled to such permit. For example, a faculty/staff permit may not be purchased for a car owned or operated by a student and vice versa.
- Student permits are valid from September 1, of the current year to August 31, of the following year. Staff and reserved permits are valid until December 31 of the year as designated on the permit. Student parking permits are issued by the Cashier’s Office located on the second floor of the Administration Building or by the Auxiliary Services Information Booth located in the Occhiato University Center. Staff, faculty and special permits are issued by University Public Safety located in the Administration Building.
ARTICLE 3 - HANDICAPPED PERMITS
- Persons requiring a permanent handicapped parking permit must register with University Public Safety and provide a valid state handicapped permit and registration issued in their name.
- A temporary handicapped parking decal may be issued by University Public Safety for temporary health disabilities upon presentation of valid documentation from a physician.
- In both a and b above, handicapped decals are issued at no additional cost with proof of a valid University parking permit.
ARTICLE 4 – TEMPORARY PERMITS
- Temporary parking permits may be issued to service vehicles operated by persons providing services to the University upon approval of the University Public Safety or University Facilities Management.
- Temporary daily parking passes may be issued by University Public Safety per notification to them prior to arrival on campus or within one hour after arrival. Daily passes are only for one vehicle for one day. All other temporary permits must be obtained at a prorated cost.
ARTICLE 5 – MOTORCYCLES AND MOTORIZED BICYCLE PERMITS
- Permits for motorcycles and motorized bicycles will be affixed in a convenient conspicuous place.
- Motorcycles must park in designated motorcycle parking areas only.
- Motorcycle owners may purchase a motorcycle permit in addition to a motor vehicle permit. The full price will be charged for both permits.
ARTICLE 6 – PLACEMENT/DISPLAY OF PERMITS/DECALS
- Parking decals will be affixed by removing the adhesive protective back and placing the decal upright on the outer portion of the rear window lower left corner or the left upper portion of the unpainted metal rear bumper.
- Permits for motorcycles and motorized bicycles will be fixed in a convenient conspicuous place on the vehicle.
- Temporary parking permits shall be attached to the interior left lower corner of the rear window or as instructed by parking management.
- Hanging permits and temporary parking permits will be placed on the rearview mirror with the permit number facing to the front.
- No vehicle can display more than one decal at any one time unless otherwise directed by University Public Safety.
ARTICLE 7 - OBLIGATIONS and OWNERSHIP
- No parking decal or temporary permit will be issued to any person, or family member, who owes an unpaid obligation to the University which was the result of a violation of the University Parking Rules and Regulations.
- All decals and permits remain the property of Colorado State University-Pueblo at all times and may be reclaimed for cause at any time, subject to subsequent hearing and appeal if requested per Section VII Article 2.
- Upon sale of a motor vehicle or other change in eligibility for motor vehicle privileges under these regulations, a decal or permit which is no longer authorized for the person or vehicle must be immediately removed from the vehicle and returned to University Public Safety.
ARTICLE 8 – REPLACEMENT PERMITS/DECALS
A replacement decal for one removed from a vehicle shall be replaced at no additional cost if the old decal is returned to University Public Safety. Otherwise the appropriate charge as listed in these Rules and Regulations shall apply per vehicle.
ARTICLE 9 - REFUNDS
- Lost or stolen permits must be reported to University Public Safety. Replacement permits will be issued per the appropriate charge listed in these Rules and Regulations
- For the Fall semester, a full refund of the semester purchase price will be issued through the last day of the drop/add period. A 50% refund of the purchase price will be issued before first day of spring semester classes.
- For the Spring semester, a full refund of the semester purchase price will be issued through the last day of the drop/add period. No refunds will be issued after the drop/add period.
- For the Summer semester, no refunds will be issued.
- All refunds are contingent on return of the permit to University Public Safety.
ARTICLE 10 - GUARANTEES
The obtaining of a decal or permit does not guarantee the holder a specific parking space.
SECTION V - PARKING PERMIT FEES
ARTICLE 1 – PAYMENT OF PARKING DECALS AND TEMPORARY PERMITS FEES
- All monies shall be paid to Business Financial Services. Student permits will be paid for in full at time of issuance. Faculty/staff permits will be paid through monthly payroll deductions for which an authorization will be signed at time of hire and kept on file in the Payroll Office. Payroll deductions may be authorized subsequent to the time of hire by completing an authorization in the Payroll Office.
- Special functions or non-related campus events may be charged a parking fee as required by University Public Safety.
- All decals purchased by an eligible person must be for the same class of affiliation to the University.
- The amount of the current parking permit fees are listed on the University website at http://www.csupueblo.edu/
SECTION VI - PENALTIES AND SANCTIONS
ARTICLE 1 – GENERAL
- Any person or vehicle found in violation of these Rules and Regulations shall be subject to receipt of a citation and one or more of the following sanctions:
2) Revocation or suspension of parking privileges,
3) Referral of the matter to the appropriate administrative officer of the University for disciplinary action.
4) Imposing of a fine. All fines shall be paid to the University Cashier’s Office in the Administration Building.
- Pueblo County Sheriff’s Office deputies can issue two types of traffic citations, those for violation of these Rules and Regulations or those for violation of State of Colorado traffic laws per Section IX, Traffic Violations.
- Campus Service Officers can issue University citations.
- Seven days from the date of the violation, a citation not otherwise waived, will be considered unpaid and delinquent.
ARTICLE 2 – CHARGES FOR PARKING VIOLATIONS

ARTICLE 3 – FAILURE TO PAY CHARGES
- Failure to respond either by appeal or by payment to four or more parking citations constitutes grounds for impoundment of a vehicle and imposition of the resulting towing and storing charges before the vehicle will be released. Such failure to respond to four or more citations will be deemed a waiver of any right to notice or a hearing before the automobile is impounded.
- In addition to any other provisions of these Rules and Regulations, any violator who incurs any monetary indebtedness will be treated as any other person who has a bill due and owing the University. Unpaid violations can result in additional fees, a hold being placed on transcripts, referral to state collections, and restriction from registering for classes.
SECTION VII - HEARINGS AND APPEALS
ARTICLE 1 – APPLEAL REQUEST
- Any person who desires an appeal hearing must notify University Public Safety in person within seven days from the date of the violation by completing the required forms per Article 2 of this Section.
- Any person who fails to request a hearing within seven days form the date of the violation shall have waived his rights to such hearing and will be subject to the monetary fee herein provided.
ARTICLE 2 – APPEAL PROCEDURES
- To appeal a University citation, report to Room 118 Administration building and request an appeal form.
- No appeal will be accepted for a citation if the request if made past seven (7) calendar days from date of issue of the citation.
- No individual shall be heard while the Traffic Appeal Board is in session unless:
1) A proper appeal form has been submitted.
2) A written request for an appearance has been received in advance and subsequent approval has been granted in writing from the Appeals Board.
- The Traffic Appeal Board will pass judgment and issue opinions based on these Rules and Regulations. Exceptions may be granted where circumstances may mitigate the infraction.
- Any individual may submit an appeal for any citation issued providing criteria one above has been met.
- An appellant may have an attorney present during a hearing but only the appellant may present his case to the Traffic Appeals Board. It will be allowed that the attorney may present to the Traffic Appeals Board a written statement in defense of his/her client. At any time during the hearing the appellant may refer to his/her attorney for any counsel he/she deems necessary.
- Circumstances such as ignorance of the Rules and Regulations, inability to find a proper parking space, or financial hardship caused by the fines do not constitutes a sufficient basis for the approval of an appeal.
- Failure to respond to charges within seven days from the date the citation was written shall be deemed a waiver of any right to notice or hearing.
- Anyone who fails to file an appeal within (seven) calendar days from date of citation shall be deemed to have waived the right and will be subject to the monetary fees as herein provided.
ARTICLE 3 – PARKING/TRAFFIC APPEAL BOARD
- The Traffic Appeal Board shall be composed of four undergraduate students appointed by the Dean of Student Life, one faculty member appointed by the Faculty Senate, one administrative staff member and one employee classified under the State Personnel System, both appointed by the Vice President for Finance and Administration and one of which shall be the Chair.
- The Parking/Traffic Appeal Board will meet monthly during the academic year and will address appeals submitted to University Public Safety since its last meeting. The Board has the final authority to affirm, reduce, or deny the sanction imposed for an alleged violation. The board also has the authority to establish a suspension of the University parking privileges for up to one year from the date of adjudication for any operator who accumulates four or more standing violations in any school academic year.
- The Parking/Traffic Appeal Board is independent of University Public Safety.
SECTION VIII - REVENUE GENERATED
ARTICLE 1 - GENERAL
All revenue derived as a result of these Rules and Regulations shall be paid into the University’s Parking Operations Fund to be used in meeting the costs of the Parking/Traffic program, for promoting campus safety, and for improving parking and campus road facilities.
SECTION IX - TRAFFIC VIOLATIONS
ARTICLE 1 - TRAFFIC VIOLATIONS
Traffic regulations on the University campus shall be enforced in conjunction with the Motor Vehicle Laws of the State of Colorado, Revised Statutes 1973, and acts amendatory thereto.
